San Francisco Bay Conservation and Development Commission (BCDC) Disclosure
(Applicable only in Alameda, Contra Costa, Marin, Napa, San Francisco, San Mateo, Santa Clara, Solano and Sonoma Counties)Legal Mandate
The BCDC is the federally-designated state coastal management
agency for San Francisco Bay and has jurisdiction in the greater San
Francisco
Bay area to administer the State's McAteer-Petris Act, the San
Francisco Bay
Plan, and the Suisun Marsh Preservation Act. In all decisions involving
wetlands, the BCDC and its staff evaluate projects in light of the
McAteer-Petris Act (the BCDC's primary law), the San Francisco Bay
Plan, the
Suisun Marsh Preservation Act, the Suisun Marsh Protection Plan, the
federal
Coastal Zone Management Act, and the California Environmental Quality
Act.
SB 1568
Requires disclosure of BCDC's jurisdiction and a specified
notice stating that the property may be subject to special
regulations, restrictions, and permit requirements to a
prospective purchaser (mirroring existing law's notice of an
airport in the vicinity) under the following conditions:
a) When a person intends to offer subdivided lands for sale
or lease, and notice thereof is made after July 1, 2005;
b) When a person intends to offer residential property
(disclosure will limit transferor liability); and,
c) When a property is being offered within a common
interest development, and notice of BCDC's jurisdiction is
through a declaration recorded on or after January 1, 2006.
